Meet Sheila Garica, our local legal expert…

Can you tell us a little more about yourself, and your law firm?
I became a lawyer when I was 23 years-old, and I have been practising since then. As I love the English language, I decided I wanted to work with English speaking people, and I moved from my hometown to Orihuela Costa 17 years ago. I absolutely love my job. For me it’s not a job, it’s a way of meeting new people and getting to know them. For me people are not just a client number. Everyone is different and needs different things, and that’s what we try to do, to find the right solution for each one of them. It has always been more important for us the quality rather than the quantity.

How difficult is it to purchase a property in Spain?
I think the process is very easy, especially if you find the right people to guide you through the process. You only need to find the right property and let lawyers guide you through the process.

What are the additional costs involved when buying in Spain?
Depending on the area, you can pay between 8% stamp duty tax, to 10% stamp duty tax. On top of this amount, you need to take into account the notary fees, land registry fees, bank fees and lawyer fees. I think it would be wise to say that you need to calculate around 14% on top for properties under 100k, and around 13% for properties over this figure.

What can I do to prepare fully before coming to Spain to buy a property?
Basically, all the process can be dealt with from Spain, should you wish to give power of attorney to your lawyer. I think the main thing is to buy the right property through a good agent or at least to have the contact and the appointments booked before coming, and then, get advice from a lawyer. Lawyers in Spain must have a civil liability insurance, which means, if anything goes wrong, you will be covered. It is very easy for a real lawyer to prove it, as we all have a lawyer’s number that nobody else can have, apart from the lawyer’s card and the insurance mentioned above.
